EBC Wind Energy Committee Meeting

Subject: Maine Supreme Court Decisions on Record Hill and Oakfield Wind Projects US

Last month, the Maine Supreme Court issued two opinions rejecting appeals of permits granted for the development of the Record Hill wind project in Roxbury and the Oakfield wind project in Oakfield. Record Hill is a 50.6 MW project proposed by Independence Wind. Oakfield is a 51 MW project proposed by First Wind. The opinions upholding the Maine Board of Environmental Protection’s (BEP) approval of both projects mean that the projects’ permits are now final and non-appealable. The court unanimously affirmed the BEP determination that both wind power projects comply with all relevant permitting standards, including the state’s strictest sound limits. The opponents had claimed that the Board was required to have held a public hearing, should have found that the projects would result in adverse health effects and did not satisfy standards related to decommissioning and financial capacity. The court disagreed, rejecting all of the opponents’ arguments.
Juliet Browne, who represented both developers in the court proceedings, will review the cases and describe the implications of these decisions on future projects proposed in Maine.
We will also discuss a proposed new sound rule being considered by the Maine DEP which would impose stricter limits on sound produced by wind turbines.
About the Presenter:
Juliet T. Browne is a Partner at Verrill Dana, and is Chair of the Environmental Law Group. She specializes in all aspects of environmental law, including project permitting under federal, state and local laws, compliance with federal and state environmental laws, litigation in state and federal courts, redevelopment of contaminated properties, and transactional matters. Since 2007, Juliet has been the lead on successfully permitting numerous major wind power projects in Maine, totaling more than 367 MW. She represents individuals, businesses and environmental groups, and works collaboratively to resolve their environmental challenges. Juliet also works with regulators and stakeholder groups to develop and update environmental regulations and programs in the State.
