At almost half a century old, the Clean Water Act has not slowed down or lost any vitality. Long-brewing fights over the scope of the law have culminated recently in two major Clean Water Act legal milestones: a final EPA rule narrowing the definition of “waters of the United States” and a Supreme Court decision expanding the circumstances under which discharge permits are required. These developments will expose a larger number of manufacturing and fuel storage and transmission facilities to Clean Water Act permitting and enforcement and also affect infrastructure development throughout the United States. This EBC Water Resources webinar will feature presentations from legal experts explaining the significance of these developments, as well as a representative of the U.S. Army Corps of Engineers to offer a practical perspective.
