EBC Site Remediation & Redevelopment Program: Environmental Risk in the Real World of Real Estate Development

Environmental due diligence is commonly used in commercial real estate transactions. The reasons for conducting such due diligence are varied, but all relate to managing different forms of risk. The due diligence process is most often guided by ASTM standards and state environmental “cleanup” regulations (e.g. the MCP in Massachusetts). Often, “business environmental risk” falls outside the realm of these documents. Sometimes, standard due diligence does not reveal all risks that must be address before a project is completed. This EBC program will deal with these types of risks, through the consideration of two case studies: one involving arsenic in soils from pesticide application and the other involving PCBs in building materials.
