Our mock case will involve High Tech Industries, Inc., a company that wants to build a new world headquarters on a high value location, and Messy Scrap Yard Incorporated, a property owner that wants to sell a 75-year-old 30-acre family-run scrap yard in the perfect spot.

The series will provide an interactive case study of the trials and tribulations of developing an old contaminated industrial property, located in Massachusetts, into a new and vibrant use. Attendees will observe the interaction between a mock buyer (High Tech Industries, Inc.) and a mock seller (Messy Scrap Yard Incorporated), along with their mock legal counsel, during acquisition negotiations, site assessment, resolution of assessment results, the funding process, final sale, and resolution of several typical development challenges.
The third program in this mock transaction scenario details the considerations, requirements, and design details related to the demolition phase of the project. This program will focus on site management and planning for demolition, hazardous material testing methodology and data evaluation including asbestos, lead paint, and polychlorinated biphenyls (PCBs) in building materials, inventorying existing tanks, vats and containers for surplus debris/hazardous materials management, Beneficial Use Determination and material management, Bulk Product versus Remediation waste for PCB impacted building materials, Potential Massachusetts Contingency Plan Notification conditions, and Resource Conservation Reauthorization Amendment (RCRA) Considerations and Disposal Issues. In addition, we will present a typical occurrence of unforeseen hazardous materials that is discovered during demolition and a conversation with the prospective purchaser on the impacts of this discovery.
