EBC New Hampshire Chapter Program: Vapor Intrusion / Due Diligence / New ASTM Phase I Standard

U.S. EPA issued its final rule on December 30, 2013 approving the use of ASTM E1527-13 “Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process”, for meeting the “All Appropriate Inquiries” (AAI) standard for environmental due diligence under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). ASTM E1527-13 incorporates three significant changes from the older ASTM E1527-05: (1) updated definitions of recognized environmental conditions (RECs) and historical RECs (HRECs), and the addition of controlled RECs (CRECs); (2) the addition of assessment for vapor intrusion; and (3) additional steps in the regulatory file-review process. Vapor intrusion’s incorporation into ASTM E1527-13 is a reflection of the recognition of the significance of vapor intrusion as a potential environmental issue at many sites, and the ongoing rapid developments in the regulation, assessment and remediation of vapor intrusion.  New Hampshire was one of the first states to develop formal vapor intrusion guidance (in 2006) and continues to be at the forefront of this issue.

The first part of this EBC New Hampshire Chapter program will discuss the recent changes in the ASTM Standard, the significance of Environmental Due Diligence to Realtors and Developers, and the application of Environmental Due Diligence to Corporate Acquisitions and Divestitures. The second portion of the Program will focus on Vapor Intrusion – including a regulatory update, the latest technologies for real time assessment, and strategies for remediation with several case studies.
