In environmental lawsuits and regulatory proceedings, attorneys and their clients routinely rely on the scientific, technical, or other specialized knowledge of expert witnesses to communicate complicated subjects and technical information to the trier of fact. Due to the complex nature of issues involved in environmental lawsuits and regulatory proceedings, expert witnesses invariably play a critical role in assisting attorneys to develop and present their cases and to meet applicable burdens of proof. Therefore, it is imperative that experts present information and testimony that is credible, truthful, and ethical, while also advancing the interests of the client – an undoubtedly daunting task for the uninitiated. Further, environmental professionals serving as consultants in seemingly non-adversarial environmental matters, for example an environmental engineer managing a hazardous waste remediation project, may find themselves unexpectedly called to testify in related litigation or enforcement cases, often years later.

At this EBC Ascending Professionals Webinar, a range of panelists consisting of attorneys, consultants, and expert witnesses will discuss strategies for preparing for and presenting effective and credible expert testimony. Panelists will also discuss, among other topics, the roles expert witnesses play in varied environmental regulatory proceedings, practice pointers for preserving legal privileges and confidentiality in adversarial proceedings, and guidance for younger professionals when hired, or called on, to serve as expert witnesses.
